Drug Offences - Penalties

NSW Courts can impose any of the following penalties for any of the above drug offences:

• Section 10 Crimes Sentencing Procedure Act ; (Charge found proven but dismissed)
• Community Service Order
• Fine
• Intensive correction order (previously periodic detention)
• Good behavior bond
• Home detention
• Suspended sentence
• Prison sentence

First Offence penalties - drug offences

Penalties for first time drug offences are obviously less than for repeat offenders and there is also a higher chance of being able to obtain a Section 10 order. However, the more serious the first offence, the less likely a section 10 order will be made.

The below table sets out the percentage of section 10 orders under the Crimes (Sentencing Procedure) Act. (More serious offences where section 10 orders are unliklely or unavailable are not included).

• Possess prohibited drug (cannabis) 38%
• Possess prohibited drug (LSD) 48%
• Possess prohibited drug (amphetamines) 44%
• Possess prohibited drug (heroin) 34%

It is also considered a drug crime using an over-the-counter drug or prescription drug for an illegal purpose.
